Training Participation Waiver
COMPREHENSIVE LIABILITY WAIVER, RELEASE OF CLAIMS, INDEMNITY AGREEMENT, AND MEDIA CONSENT
This Agreement ("Waiver") is entered into voluntarily by the undersigned individual ("Participant") for the benefit of RTR Professional Services LLC, a California-based and registered limited liability company in good standing, authorized to operate in accordance with all applicable state and federal laws. This includes, but is not limited to, full compliance and protection under the California Corporations Code and any other relevant regulatory frameworks. The term "Released Parties" includes RTR Professional Services LLC and any and all affiliated or associated entities, property owners or managers, venue operators, landlords, lessees, contractors, employees, volunteers, staff, maintenance and facilities personnel, officers, directors, agents, vendors, sponsors, and any other party acting in coordination with or on behalf of RTR Professional Services LLC.
1. Voluntary Participation Acknowledgment Participant acknowledges that participation in any and all activities or presence at any site, facility, or property operated, controlled, facilitated, hosted, or otherwise connected to the Released Parties is strictly voluntary. Participant affirms they are under no obligation or coercion to participate.
2. Assumption of Risk Participant understands that physical, mental, emotional, and environmental activities carry inherent risks, including but not limited to injury, illness, emotional trauma, property loss, or death. These risks may arise from the actions or negligence of Participant, other participants, Released Parties, third parties, equipment, or environmental conditions. Participant accepts full responsibility for all such risks.
3. General Release and Waiver of Liability To the fullest extent permitted by law, Participant releases, waives, and forever discharges the Released Parties from any and all claims, actions, liabilities, losses, costs, or demands—known or unknown, foreseen or unforeseen—arising from or related to participation in the activity or presence on site.
4. No Negative Publication Clause Participant agrees that in the event of a dismissal for any reason deemed reasonable and appropriate by the Released Parties, not to make or publish negative, defamatory, or disparaging remarks, reviews, social media posts, blogs, or commentary—whether oral, written, or digital—against the Released Parties. Breach may result in legal remedies including injunctive relief and damages.
5. Responsibility for Damages Participant agrees to assume full financial responsibility for any property damage or loss they cause, including reimbursement, repair, or replacement, regardless of ownership.
6. Medical Treatment and Insurance Disclaimer Participant acknowledges that RTR provides no medical or health insurance coverage, and any medical treatment, medication, transport, or aftercare is the sole responsibility of the Participant. RTR may provide emergency first aid and activate EMS but assumes no further liability.
7. Media and Likeness Consent Participant grants RTR full rights to use photographs, videos, or recordings of their likeness for lawful promotional, advertising, documentation, and informational purposes. All media becomes the exclusive property of RTR. Names will not be published without written consent. RTR agrees never to sell personal data.
8. Indemnification Participant agrees to indemnify, defend, and hold harmless the Released Parties from any and all claims, liabilities, costs (including attorney’s fees), damages, or losses resulting from Participant’s actions, conduct, or violations of this Agreement.
9. Force Majeure The Released Parties are not liable for any interruption, injury, or cancellation caused by events beyond their control, including but not limited to acts of God, weather events, pandemics, public emergencies, terrorism, power failures, or governmental action.
10. Legal Capacity and Physical Fitness Participant certifies they are of sound mind, not impaired by alcohol or drugs, and legally competent to enter into this Agreement. They further affirm they are physically and mentally fit to participate and have disclosed any conditions requiring accommodation.
11. No Expectation of Privacy Participant understands that activities may occur in spaces where privacy is limited or nonexistent and accepts that Released Parties are not liable for third-party media capture or distribution.
12. Minor Participation If the Participant is under 18 years of age, this waiver must be signed by a parent or legal guardian who consents to all terms on the minor’s behalf and waives the minor’s right to bring legal action.
13. Employment Disclaimer Participant understands they are not an employee, agent, or contractor of RTR and are not entitled to any wages, insurance, or benefits.
14. Compliance with Rules and Safety Protocols Participant agrees to abide by all posted or communicated safety rules, directions, and conduct expectations. Failure to do so may result in removal without refund or liability.
15. Waiver of Unknown or Future Claims (CA Civil Code §1542) Participant expressly waives all rights under California Civil Code Section 1542, which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor...”.
16. Entire Agreement and Modification This document represents the full understanding between the parties and supersedes all prior agreements or statements. Modifications must be in writing and signed by both parties.
17. Voluntary Execution Participant certifies that they have read and fully understand this Agreement, were given the opportunity to ask questions or consult legal counsel, and are signing voluntarily, free from coercion or duress.
18. Additional Clauses
• Participant agrees not to consume alcohol or drugs before or during activities.
• Weapons are not permitted unless authorized by RTR in writing.
• Pets or animals are not allowed unless disclosed and approved.
• Participant agrees to maintain confidentiality of sensitive information if applicable.
Governing Law and Jurisdiction
This Agreement shall be governed by the laws of the State of California, with exclusive jurisdiction in the courts of the appropriate county in California where RTR maintains operations.
